There are two kinds of subclasses: short-term and long-term. At first, partners who meet the legal requirements for a visa are given a temporary visa. Then, after a waiting period or right away, a permanent visa could be issued if there is a well-established relationship or children from the relationship.
Partner class movement also considers the temporary entry to Australia of the fiance(e)s of Australian residents, Permanent residents, and qualified New Zealand residents.
As the partner or fiance(e) of an Australian resident, permanent Australian resident, or qualified New Zealand resident, you are not eligible for a permanent home in Australia. If you want to live in Australia for the rest of your life, you should apply for a partenr visa and be checked against the legal requirements for getting that visa.
Let’s take a quick look at the partner subclass visas that were available in your area at the time of application:
As long as you are in Australia, you can apply for a Partner Temporary Visa (Subclass 820) and a Permanent Visa (subclass 801). You can use this visa to stay in Australia with your partner, who must be a resident of Australia, a “a permanent resident permanently settled in Australia ” of Australia, or a qualified New Zealand resident. You can get a permanent visa if the relationship is still valid after two years.
Taking for granted that you are not in Australia: Partner’s Temporary Visa (Subclass 309) and Permanent Visa (Subclass 100): You can use this visa to enter and stay in Australia with a person who is an Australian resident, Australian super durable occupant, or qualified New Zealand resident. You can get a permanent visa if you stay in a stable, honest relationship for a long time after you use this visa.
This is for people who want to come to Australia before getting married. To apply for this visa, your life partner must be an Australian citizen, an Australian super durable resident, or a qualified New Zealand resident. When they get married, people with this visa can apply for a Partner visa to stay in Australia forever.
There are a few general requirements to meet before you can apply for this visa:
It would help if you were supported by a person who is a resident of Australia, a permanent resident of Australia, or a qualified resident of New Zealand. This person could be your fiance(e), a friend, or in some cases, the parent or guardian of your friend. This person must also meet the legal requirements for being a support.
You also have to meet health and character standards.
If you have subordinate children or other ward family members, they may be able to join your application if they meet specific requirements.
No matter what, if you meet specific requirements after September 14, 2009, you might be able to apply for a Partner visa in Australia. These four things must be:
Since you last went to Australia, you shouldn’t have had a partner visa cancelled or refused.
Under section 501 of the Act, you shouldn’t have had a visa denied or cancelled because of your character.
You should include a Form 40SP Sponsorship for a Partner to Move to Australia that has been filled out and signed by an Australian resident, Australian permanent resident, or qualified New Zealand resident who says they are your true partner.
You should include with your application two legal statements from Australian residents, Australian residents who have lived there as permanent residents, or qualified New Zealand residents (other than your partner) saying that you and your partner are in a relationship. These announcements should have been made no more than a month before the Partner visa was applied for.
